These Terms of Service ("Terms") govern access to and use of the websites bert.fi and alb3r7.fi (the "Sites") and the internal marketing-operations tooling — including Model Context Protocol (MCP) servers integrating with Google, Meta, LinkedIn, and TikTok marketing APIs (the "Tooling") — operated by Alb3r7 Oy, a company registered in Finland and based in Espoo ("we", "us", "our").
By accessing the Sites, by being granted access to the Tooling, or by authorizing us via OAuth to operate a marketing account on your behalf, you agree to these Terms.
Alb3r7 Oy is a marketing agency. The Sites function as informational presences for the company and its ventures. The Tooling is an internal, non-public application that we use to operate marketing accounts owned by our clients, under explicit authorization.
The Tooling is not a software-as-a-service product offered for sale, license, or self-service signup. It is operated exclusively by Alb3r7 Oy personnel in connection with engagements agreed with our clients.
Where a client grants Alb3r7 Oy access to a marketing account (for example via OAuth, via the addition of an agency user, or via Meta Business Manager / Google Ads MCC / LinkedIn agency partner permissions), that grant constitutes the client's authorization for us to:
The client may revoke this authorization at any time, with effect that we will lose API access to the account and will delete associated OAuth tokens.
You may not use the Sites or any data obtained from them to:
We may terminate or restrict access to the Sites or the Tooling at any time if these Terms are breached.
When operating client accounts via third-party APIs, we comply with the terms of the underlying platform, including:
Where these platform terms impose obligations on Alb3r7 Oy or on the client, the platform terms govern in the event of conflict with these Terms.
All content on the Sites — including text, graphics, layout, and code — is owned by Alb3r7 Oy or its licensors and is protected by Finnish and international copyright law. You may view and download content for personal, non-commercial reference. Any other use requires written permission.
Client-owned content (advertising assets, copy, performance data) remains the property of the respective client at all times.
The Sites and the Tooling are provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Sites will be uninterrupted or error-free, that data retrieved via the Tooling will be free of inaccuracies introduced by upstream platforms, or that any specific marketing outcome will be achieved.
To the maximum extent permitted by applicable law, Alb3r7 Oy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Sites or the Tooling, even if advised of the possibility of such damages.
Our aggregate liability under any engagement involving the Tooling shall not exceed the fees paid by the relevant client to Alb3r7 Oy during the three (3) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded under mandatory Finnish law (including liability for gross negligence or wilful misconduct).
You agree to indemnify and hold harmless Alb3r7 Oy from any claims, damages, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Sites or the Tooling, or your violation of any third-party right or applicable law in connection with your use.
We may suspend or terminate access to the Sites or the Tooling at our discretion, including in the case of breach of these Terms, termination of an underlying client engagement, or as required by law. Sections that by their nature should survive termination — including Sections 6 (Intellectual Property), 7 (No Warranty), 8 (Limitation of Liability), 9 (Indemnification), and 11 (Governing Law) — will continue to apply after termination.
These Terms are governed by the laws of Finland, excluding its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be resolved in the District Court of Helsinki (Helsingin käräjäoikeus) as the court of first instance, unless mandatory consumer-protection law provides otherwise.
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the latest revision. Continued use of the Sites or the Tooling after a revision constitutes acceptance of the updated Terms.
